These Terms of Service ("Terms") govern the use of the Artiflex Studio platform, operated by Santallana Technology Corporation, registered in the state of Florida, United States, under the trade name "Artiflex Studio" (DBA).

By using our services, you agree to comply with these Terms. If you do not agree, you must stop using the platform immediately.

1. Service Description

Artiflex Studio offers digital and physical solutions for businesses, including but not limited to:

• NFC business cards with Apple Wallet and Google Wallet integration
• CRM and lead capture from NFC card visitors
• An online store for physical products (such as NFC cards, acrylic and vinyl signs, and wall art)
• Design and production of acrylic and vinyl signs
• Other related IT services

Services are available in English and Spanish.

2. Registration and Account

To access certain features, users must create an account. It is the user's responsibility to:

• Provide accurate and up-to-date information
• Keep their password secure
• Not share their account with third parties

3. Subscriptions and Payments (Web)

• Subscriptions are monthly
• We offer 15 days of free trial without requiring a payment card
• Once the payment period begins, no refunds are issued, but the service will remain active until the end of the billing cycle
• Web payments are processed through Stripe, which securely manages payment information

3a. Apple In-App Purchases (iOS App Only)

If you subscribe through the Artiflex Studio iOS app, your subscription is processed by Apple via In-App Purchase and is governed by Apple's Standard EULA in addition to these Terms.

Subscription details:

• Product: NFC Card Monthly
• Length: 1 month, auto-renewable
• Price: USD $4.99 per month (or local equivalent set by Apple)
• Free trial: 15 days for new accounts. Any unused portion of a free trial period is forfeited when you purchase a subscription.

Auto-renewal terms:

• Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
• Apple will charge your iTunes Account within 24 hours prior to the end of the current period at the rate of the selected subscription.
• The renewal cost will be the same as the subscription unless Apple notifies you of a price change at least 30 days in advance.

Cancellation:

• You can manage or cancel your subscription anytime in Settings → Apple ID → Subscriptions on iOS, or at apps.apple.com/account/subscriptions.
• Cancellation takes effect at the end of the current paid period; you keep access until then.
• Refunds for App Store purchases are handled by Apple. Contact Apple Support for refund requests.

Cross-platform note:

If you already have an active subscription via our website (Stripe), the iOS app will not allow you to subscribe again via Apple to prevent double billing. You will see "Subscribed on the web" instead of the Subscribe option.

4. Store and Physical Product Orders

When you order a physical product from our store (for example, NFC cards, acrylic or vinyl signs, or wall art), checkout is processed by Stripe and orders are fulfilled and shipped through our carriers (rates and labels via Shippo).

Physical product orders are subject to our store policies, which form part of these Terms:

• Shipping Policy

Unlike digital subscriptions, eligible physical products may be returned or refunded as described in the Refund Policy. Custom or personalized items may be non-returnable as stated there.

5. Permitted and Prohibited Use

The user agrees to:

• Not upload illegal, offensive, defamatory, discriminatory or copyright-infringing content
• Not use the platform for fraudulent or illicit activities
• Ensure that information published in their modules (prices, contact details, descriptions, etc.) is correct and up-to-date

Santallana Technology Corporation is not responsible for errors, omissions or false data entered by users.

6. Lead Capture and Visitor Data

Our CRM and "Exchange Contact" features let you collect contact information from people who visit your NFC card. As the party that decides why and how this information is used, you are responsible for handling it lawfully — including obtaining any consent required and complying with applicable privacy laws. Artiflex Studio processes this information on your behalf to provide the CRM feature.

7. Intellectual Property

All rights to the platform, logos, designs, code and materials are the property of Santallana Technology Corporation or its licensors. Users retain rights to their own content but grant Artiflex Studio a non-exclusive license to host and display it on the platform for the purpose of providing the service. ARTIFLEX STUDIO® is a registered trademark of Santallana Technology Corporation, registered with the United States Patent and Trademark Office.

8. Suspension, Cancellation and Termination

We may suspend or cancel accounts that violate these Terms without prior notice. You may stop using the service and delete your account at any time from your account settings; deletion is subject to the retention terms in our Privacy Policy.

9. Disclaimer of Warranties

The platform and all services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Santallana Technology Corporation and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of (or inability to use) the platform. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the services will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Santallana Technology Corporation and its officers, employees and agents from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from: (a) your content; (b) your use of the platform; (c) your violation of these Terms or of any law or third-party right; and (d) your handling of contact data you collect from visitors of your NFC card.

12. Governing Law

These Terms are governed by the laws of the State of Florida, USA. Any disputes will be resolved in the state or federal courts located in Florida.

13. Changes to These Terms

We may update these Terms at any time. We will update the date above and, for material changes, provide notice. Your continued use of the platform after the changes take effect constitutes acceptance of the updated Terms.
